Welcome to LabSense Health. These Terms of Service ("Terms") govern your access to and use of the LabSense Health website, mobile applications, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Acceptance of Terms
By creating an account or using the Service, you represent that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using the Service under applicable laws
- You will comply with these Terms and all applicable laws and regulations
2. Description of Service
LabSense Health provides an AI-powered platform that helps users understand their health data by:
- Extracting data from uploaded lab reports, prescriptions, and medical documents
- Providing educational explanations of test results and health markers
- Tracking health trends over time
- Generating summaries and insights about your health data

3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
4. Acceptable Use
You agree NOT to use the Service to:
- Upload content you do not have the right to share
- Upload another person's health data without their explicit consent
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Service for any illegal purpose
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble the Service
- Use automated systems to access the Service without permission
- Resell, redistribute, or sublicense the Service
5. Your Content
You retain ownership of all content you upload to the Service ("Your Content"). By uploading content, you grant LabSense Health a limited license to:
- Process and analyze Your Content to provide the Service
- Store Your Content securely on our systems
- Display Your Content back to you within the Service
We do NOT use Your Content to train AI models, sell to third parties, or for any purpose other than providing you with the Service.
6. Subscriptions and Payment
Some features of the Service require a paid subscription:
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as described in our Refund Policy
- We may change subscription fees with 30 days' notice
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by LabSense Health and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks may not be used without our prior written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties regarding the accuracy, reliability, or completeness of any information
- Warranties that the Service will be uninterrupted, secure, or error-free
We do not warrant that the results obtained from using the Service will be accurate or reliable for any medical purpose.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LABSENSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless LabSense Health and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may request deletion of your data by contacting support@labsense.health.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
